Terms of Service

Welcome to Hamtrax. By accessing or using the Hamtrax application, website, and related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

1. Acceptance of Terms​

By creating an account or using any part of the Service, you confirm that you are at least 13 years of age and agree to comply with these Terms. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization.

2. Description of Service​

Hamtrax is a ham radio toolkit that provides logging, activity discovery, award tracking, mapping, and related tools for amateur radio operators. The Service may include web applications, mobile applications, and APIs.

3. User Accounts​

  • You are responsible for maintaining the confidentiality of your account credentials.
  • You agree to provide accurate information during registration, including your callsign if applicable.
  • You are responsible for all activity that occurs under your account.
  • You must notify us immediately if you suspect unauthorized use of your account.

4. Acceptable Use​

You agree not to:

  • Use the Service for any unlawful purpose or in violation of amateur radio regulations.
  • Upload, transmit, or distribute any content that is harmful, threatening, abusive, defamatory, or otherwise objectionable.
  • Attempt to gain unauthorized access to other users' accounts, the Service's infrastructure, or related systems.
  • Interfere with or disrupt the Service or servers connected to the Service.
  • Use automated means (bots, scrapers, etc.) to access the Service without prior written permission.
  • Impersonate another person or misrepresent your callsign or identity.
  • Upload malicious code or attempt to exploit vulnerabilities in the Service.

5. User Content​

  • You retain ownership of any content you submit to the Service (QSO logs, profile information, photos, field notes, livestream URLs, etc.).
  • By submitting content, you grant Hamtrax a non-exclusive, worldwide, royalty-free license to use, store, display, and distribute your content as necessary to operate and improve the Service.
  • You are solely responsible for the accuracy of your logged data and submitted content.
  • We reserve the right to remove content that violates these Terms.

6. Third-Party Data and Services​

  • The Service may integrate with third-party data sources (QRZ, HamQTH, LoTW, N1MM, POTA, Reverse Beacon Network, PSK Reporter, FCC database, etc.). We do not control and are not responsible for the accuracy or availability of third-party data.
  • Callsign lookups, propagation data, and other external data are provided "as is" without warranty.
  • Your use of third-party authentication providers (Google, Apple) is subject to their respective terms.

7. Privacy​

Your use of the Service is also governed by our Privacy Policy. Please review it to understand how we collect, use, and protect your information.

8. Subscriptions and Payments​

  • Hamtrax may offer paid subscription plans with additional features. Billing is handled entirely by Stripe, Inc. — we do not store your credit card number or full payment details.
  • Subscriptions auto-renew at the end of each billing period unless you cancel. You can manage or cancel your subscription at any time through the Stripe-hosted billing portal accessible from your account settings.
  • Refunds are handled in accordance with Stripe's policies. If you believe you are entitled to a refund, contact us at info@hamtrax.com.
  • We reserve the right to change subscription pricing with reasonable notice. Price changes will not apply to your current billing period.

9. Intellectual Property​

  • The Service, including its design, code, branding, and documentation, is owned by Hamtrax and protected by applicable intellectual property laws.
  • You may not copy, modify, distribute, or reverse-engineer any part of the Service without prior written permission.

10. Availability and Modifications​

  • We strive to keep the Service available but do not guarantee uninterrupted access. The Service may be temporarily unavailable for maintenance or updates.
  • We reserve the right to modify, suspend, or discontinue any feature of the Service at any time.
  • We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the revised Terms.

11. Termination​

  • You may delete your account at any time through the app's settings. Account deletion removes your authentication credentials.
  • We may suspend or terminate your account if you violate these Terms or engage in activity that harms the Service or other users.
  • Upon termination, your right to use the Service ceases. We may retain certain data as required by law or for legitimate business purposes.

12. Disclaimers​

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. HAMTRAX DISCLAIMS ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The Service will meet your specific requirements.
  • The Service will be uninterrupted, secure, or error-free.
  • Data provided through the Service (propagation forecasts, callsign lookups, location data) will be accurate or complete.

13. Limitation of Liability​

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HAMTRAX AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR LOSS OF QSO RECORDS.

14. Governing Law​

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
